A multi-million trust dispute among siblings in the Bay Area is usually three fights wearing one caption. One is about the document: was the amendment signed in the hospice month really Mom's decision. One is about the trustee: the accounting, the self-dealing, the sibling living in the house for free. One is about the assets: the Palo Alto house, the company, and when it all gets sold.
Here's the thing. Most of these cases settle at mediation, typically twelve to twenty-four months in, and the trust should not pay for anyone's side of it. The sibling who files first with a clear petition and a clean file usually sets the terms. Patterns, not promises.
How does a multi-million trust dispute among siblings start?
Siblings fighting over inheritance rarely start with theft. They start with silence after the funeral and an amendment nobody knew about that moved the Saratoga rental to the child who lived closest.
A contest of the amendment: once the trustee's notice is served, a contest must be filed within 120 days (Probate Code § 16061.8); our guide to how to contest a trust in California covers that petition. An accounting demand: a beneficiary can petition to compel one after the trustee ignores a written request for 60 days (Probate Code § 17200). What are the phases of a multi-asset trust case?

Appraisers value the real estate at death and again at distribution. A forensic accountant rebuilds the books from bank statements. A good faith estimate satisfies the account for a house or a closely held business (Probate Code § 1063); an appraisal wins the argument.

Can a sibling co-trustee be removed for hostility alone?
No. Parents name all the children co-trustees to be fair. It is the least fair thing they can do. Unless the trust says otherwise, co-trustees act only by unanimous action (Probate Code § 15620), so one sibling can block a sale for a year by not signing.
The court can remove a trustee "Where hostility or lack of cooperation among cotrustees impairs the administration of the trust" (Probate Code § 15642). The key word is impairs. Hostility justifies removal "when the hostility impairs the proper administration of the trust" (Gilmaker v. Bank of America). In Trolan v. Trolan the trial court removed sibling co-trustees and ordered everything sold; the appeal court reversed, because one dissenting sibling "does nothing to impair" a majority that can act.
So the first order in a deadlocked sibling trust is usually a temporary trustee (Probate Code § 17206) or an agreed professional fiduciary, not a removal trial. If the instrument names no successor, all the adult current beneficiaries can agree on a trust company (Probate Code § 15660). Refuse that request, and if the court later removes you and appoints a trust company, the petitioner's fees can land on you (Probate Code § 15645).
Two limits. The removal ground aimed at drafters and paid caregivers does not reach a trustee related to the settlor by blood or marriage, so a daughter is not removed on that ground just because the amendment favored her (Probate Code § 15642). And a bad-faith petition that would defeat the settlor's intent can leave the petitioner paying the trustee's fees (Probate Code § 15642). Who pays the lawyers in a sibling trust dispute?
The trustee hires a lawyer, as she may (Probate Code § 16247), and pays from the trust account. The trust repays expenditures "properly incurred in the administration of the trust" (Probate Code § 15684). A fight among the beneficiaries over who gets what is not administration.
In a dispute over who the rightful beneficiary is, the trustee "ordinarily must remain impartial, and may not use trust assets to defend the claim of one party against the other" (Doolittle v. Exchange Bank). A trustee-daughter who took her siblings' side against the widow "must bear her own costs in this litigation, rather than be reimbursed from the trust" (Terry v. Conlan). In Zahnleuter v. Mueller a trustee spent about $201,000 of trust money defending an amendment and was ordered to repay it.
Beneficiaries "must generally pay their own attorney's fees incurred challenging a trustee's conduct, even if they succeed" (Smith v. Szeyller). A sibling who litigates in bad faith can have the trustee's fees charged against his share (Rudnick v. Rudnick; Pizarro v. Reynoso). On an account contest, fees run both ways: a bad-faith, unreasonable objection costs the objector, and a bad-faith, unreasonable defense costs the trustee personally (Probate Code § 17211).
Two more exposures. A court that finds property was taken in bad faith, or through financial elder abuse, can order the taker to pay "twice the value of the property recovered" (Probate Code § 859). Whether the elder-abuse prong needs a separate bad-faith finding is a split between Levin v. Winston-Levin and Keading v. Keading. And a no-contest clause reaches a direct contest only if it was "brought without probable cause" (Probate Code § 21311), so a sibling with a real basis does not forfeit her share by filing. A sibling who files after the 120 days can, because a late contest is treated as one without probable cause (Meiri v. Shamtoubi).

How does estate mediation work in Santa Clara County?
Santa Clara County offers two doors. The court's Probate Early Settlement Conference Program is open to parties who stipulate on form PB-4063 and pick a neutral from the court's list (Probate Local Rule 3(B)). It "is not a mediation, as defined in Evidence Code § 1115" and "There is no provision for confidentiality of communications" (Probate Local Rule 3(B)(4)). A private mediation is different: nothing said in it is admissible or discoverable (Evidence Code § 1119).
A mediation day is four siblings, four spouses, four lawyers, separate rooms, and a retired judge walking numbers down the hall. The sister who wants the Menlo Park house can take it against her share with an equalizing payment; non-pro-rata distributions are allowed (Probate Code § 16246).
For the sibling who wants to sit it out: in Breslin v. Breslin, beneficiaries who received notice of a court-ordered mediation and stayed home were held bound by the deal the others made. The court limited that holding to "the circumstances here" and one justice dissented, so a no-show can be bound, not always is.
How should a trustee act while the siblings are fighting?
Act impartially and write down why. The trustee must "deal impartially with them" (Probate Code § 16003), and sole discretion still means acting "in accordance with fiduciary principles" (Probate Code § 16081). Before every big decision, send a notice of proposed action with the reasons and at least 45 days to object (Probate Code § 16502). No written objection, no liability for that action (Probate Code § 16503).
A beneficiary who consents in writing, knowing the facts, cannot later sue over the act (Probate Code § 16463), and a release works the same way unless the facts were withheld (Probate Code § 16464). Send an early, honest accounting. A beneficiary who receives an account that "adequately discloses the existence of a claim" has three years to sue on it (Probate Code § 16460).
Now the texts. Civil discovery rules apply, so the sibling group chat and the midnight voice memo are discoverable. Assume every message will be read aloud in a courtroom in San Jose. Your own lawyer is the exception: a trustee "may assert the attorney-client privilege against the beneficiaries" (Wells Fargo Bank v. Superior Court).

What should you do next in a sibling trust dispute?
- Gather the trust, every amendment, the trustee's notice, and the last account.
- Calendar the 120 days and confirm the date with a lawyer this week.
- Trustee: freeze anything unusual, send the accounting, and hire counsel under two engagement letters.
- Beneficiary: demand the accounting and the trust terms in writing, dated, by mail and email.
- Order the appraisals early and propose a private mediation.

How long does a sibling trust dispute take in the Bay Area?
A multi-property case with three or four siblings typically settles at mediation twelve to twenty-four months after the first petition, and the few that go to trial run longer. No lawyer can promise you a date.
Can the trust pay my legal fees?
If you are the trustee, the trust can pay for administration, accounting, and defending the trust's assets, subject to the judge's review when the account is settled (Probate Code § 15684). It does not pay for your side of a fight over who inherits (Doolittle v. Exchange Bank).
Can we mediate before anyone files?
Yes, and it is worth one honest try with the appraisals in hand. But the 120-day contest clock does not pause while you talk (Probate Code § 16061.8), so if the deadline is close, file first.
What if one sibling refuses to participate in estate mediation?
A sibling who gets proper notice of a court-ordered mediation and stays home can be bound by the result (Breslin v. Breslin), though the court limited that holding to its facts. The court's own settlement program requires a stipulation, so a refusal there means private mediation or a trial date.
Does a no-contest clause stop us from objecting to the accounting?
No. A no-contest clause is enforced only against a direct contest brought without probable cause, plus two narrow kinds of pleadings the clause must expressly name (Probate Code § 21311). A direct contest attacks the validity of the document itself on grounds like forgery, lack of capacity, or undue influence (Probate Code § 21310). Objecting to an accounting is not that.
Do we need a trust dispute attorney if we all still get along?
Maybe not a litigator, but you need the paperwork done right: the notice served, the accounting sent, and any deal among siblings written as consents and releases after full disclosure (Probate Code § 16463).
